Oleksandr Polivodskyy has analysed key judgments of the ECHR in land disputes

In addition to the national legal provisions governing land-related relations, conclusions of the European Court of Human Rights are critical to the adjudication of land-related disputes by courts. And this is not only about judgments the ECHR delivers against the Ukrainian state.

As part of the training entitled 'Land Education,' Sofiya Law Firm Partner Mr Oleksandr Polivodksyy has analysed the case law of the European Court of Human Rights that is relevant to Ukraine.

In particular, the expert has brought the attendees' attention to certain legal concepts and doctrines as reflected in a number of the ECHR's judgments, such as legal certainty, good governance, legitimate aim, free exercise of discretion of policy makers, legal expectation, fair balance of interests of an individual and the society, etc.

The three-day training entitled 'Land Education' was organised these recent days by the Coordination Centre for Legal Aid Provision and the World Bank as part of the project 'Transparent Land Management in Ukraine.' A special study was conducted by reputable Ukrainian experts specialised in land-related legal relations, including Mr Polivodskyy.


Those attendees who were issued certificates following the training will provide cascade training regarding 'Land Education' in the Kyiv, Mykolaiv and Lviv Regions.
