Sofiya Law Firm and PlantAgro advise agribusiness on legal issues

In Ukraine, the preparations for the land market implementation are being held. In this regard, Sofiya Law Firm and PlantAgro have launched a series of video consultations on legal issues for agribusiness. 

The first of them is devoted to the idea of unshadowing of agricultural production, which was implemented in the draft law on amendments to the Tax Code of Ukraine and other laws of Ukraine. It was registered under № 3131-д and is currently being processed by expert Divisions of the Verkhovna Rada.

The analysis of the initiative was presented by Sofiya Law Firm partner Mr Oleksandr Polivodskyy. The document proposes to introduce a "fixed tax liability" - the minimum amount that must be paid by all owners and users of agricultural land from the income from its use.

"Up to 5% of the normative monetary value of land, which will be about 1400 - 1500 UAH per hectare will be paid annually by owners and users who have not leased the land, - explains O. Polivodskyy. "The attitude toward such an initiative is ambiguous among the experts and discussions are still ahead."

Lawyer advises land and business owners to prepare for the new legal conditions.

"Everyone should check whether the proprietary rights or rights of exploitations of land are properly registered. Legal entities should conduct an audit of the landbank to make sure that it is in right condition, - O. Polivodskyy believes. "Those shortcomings that seem small today can become significant obstacles to further business doing and its development planning under the new legal conditions."
