Prohibition of Contradictory Behavior in Land Disputes: Oleksandr Polivodskyy will investigate the case law


One of the principles of Ukrainian civil law is a good faith. The Supreme Court of the country determines it as a certain standard of behavior, characterized by honesty, openness and respect for the interests of the other party. And this standard forms the basis of the doctrine of venire contra factum proprium (prohibition of the contradictory behavior).

The Sofiya Law Firm partner, Mr. Oleksandr Polivodskyy will hold a webinar on "The Doctrine of Prohibition of Contradictory Behavior and Its Application on the Example of Land Disputes" at the Higher School of Advocacy.

The event, which will take place online on December 29, 2020, will include an analysis of three interrelated blocks of issues:

- notions of doctrine and related concepts;

- procedural legislation of Ukraine on a bad faith;

- Ukrainian case law and recent trends.

The popularization of the concept, in particular in the professional environment through the opportunities of the Higher School of Advocacy, and its widest possible application by the lawyers in practice will certainly contribute to the improvement of national jurisprudence, - convinced the Sofiya Law Firm partner. "And the identified gaps and drawbacks will also create a basis for further reforms of land legislation in Ukraine."

The expert will make conclusions from the webinar and provide practical recommendations in the context of land disputes.
